By using the site and/or placing an order, the Customer confirms they have read and accept these Terms & Conditions.
1. Products and information
Pandeabeauty.com offers cosmetic products under the Pandea Beauty brand. Key characteristics, quantity, intended use, method of use, ingredients and price are stated on the relevant product page and/or on the packaging. Product photos are for illustrative purposes. Minor differences in colour and appearance are possible depending on the device and display used. The Customer should use the products in accordance with their intended purpose and the instructions on the packaging.
2. Prices and promotions
Prices published on the site are the final selling prices for the relevant product, unless expressly stated otherwise. The delivery fee is shown separately before the order is finally confirmed. Pandea Beauty may change prices and run promotional campaigns. A price change does not affect an already confirmed order. Where a discount is advertised, the applicable legal requirements on stating the prior and reduced price are followed.
3. Orders and conclusion of contract
Orders are placed online via pandeabeauty.com by selecting the product, quantity, delivery method and payment method. Before submitting the order, the Customer can review and correct the entered data. After the order is successfully submitted, the Customer receives confirmation of the details they provided. Where necessary, Pandea Beauty may contact the Customer to clarify order details. If an ordered product is unavailable, the Customer is notified as soon as possible, and where the product was prepaid, the amount for the undelivered product is refunded.
4. Payment
Payment can be made using the methods available on the site, including Visa/Mastercard bank cards and cash on delivery, where that option is available. For card payments, the transaction may be processed by an external licensed payment provider under its own rules and security requirements.
5. Delivery
Deliveries within the Republic of Bulgaria are made through the courier company Speedy, to an office or address depending on the service chosen by the Customer. The standard delivery time is 1–3 business days after the order is processed and confirmed. Delays are possible around public holidays, promotional campaigns, exceptional load on the courier network, or other circumstances beyond the Trader’s reasonable control. Where no other timeframe has been agreed, delivery is made within the statutory time limit. The Customer is responsible for providing accurate delivery details.
6. Receiving the parcel
Upon receipt, the Customer should check the external condition of the parcel. If transport damage is visible, it is advisable to have this recorded in the courier’s presence and, if necessary, to have a report drawn up. If the Customer receives a product other than the one ordered, or a product with an obvious defect or damage, they should contact Pandea Beauty through the contact details published on the site.
7. Right of withdrawal for online purchases
A Customer who qualifies as a consumer under applicable law has the right to withdraw from a distance contract within 14 calendar days of receiving the goods, without stating a reason. To exercise the right of withdrawal, before this period expires the Customer must send an unambiguous written statement to Pandea Beauty via the e-mail address published in the “Contact” section of pandeabeauty.com, or by another written means of contact stated on the site. After giving notice, the product must be returned within the statutory time limit. The direct cost of returning the product is borne by the Customer, unless Pandea Beauty has expressly stated otherwise. Returned parcels should not be sent cash-on-delivery.
8. Limits on the right of withdrawal for opened cosmetic products
Due to the nature of cosmetic products, the right of withdrawal does not apply to sealed goods that have been unsealed after delivery and which, for reasons of health protection or hygiene, are not suitable for return. Where a product has a protective film, seal, security sticker or other hygiene sealing, it must remain intact for the product to be returned on the basis of the right of withdrawal. This limitation does not affect the Customer’s statutory rights in respect of a defective, damaged, non-conforming or incorrectly shipped product.
9. Refunds
Where the right of withdrawal has been validly exercised, Pandea Beauty refunds the amounts due in accordance with applicable law, including the cost of standard initial delivery, where due. Refunds are generally made using the same payment method used for the purchase, unless the parties have expressly agreed otherwise. The Trader may withhold the refund until the goods are received back, or until proof has been provided that they have been sent back, where the law allows this. Additional costs arising from choosing a delivery method more expensive than the standard option offered are not refunded.
10. Complaints and statutory warranty
The Consumer has the statutory rights that apply where purchased goods do not conform to the contract. Where a non-conformity or defect appears within 2 years of receiving the goods, the Customer may raise a complaint in accordance with applicable law. A complaint can be submitted in writing via the e-mail address published in the “Contact” section of pandeabeauty.com. It is helpful to include the order number, a description of the issue and, if possible, photos of the product, as well as proof of purchase. Complaints are handled within the statutory time limits. The Consumer’s rights cannot be limited by these Terms & Conditions.
11. Use of cosmetic products
Before use, the Customer should review the ingredients and instructions on the product. Where an allergy or sensitivity to a particular ingredient is known, the INCI ingredient list should be checked before use. If an adverse reaction occurs, use of the product should be discontinued and, if necessary, medical advice should be sought. Individual results from using a cosmetic product may vary between users.
12. Intellectual property
The content of pandeabeauty.com, including the Pandea Beauty brand and logo, product images, photos, text, graphics and design, is protected under applicable intellectual property law. Copying, reproducing, distributing or using this content for commercial purposes without the prior permission of the rights holder is not permitted, except in cases provided for by law.
13. Site operation and liability
Pandea Beauty takes reasonable care to keep the information on the site up to date and the online shop running normally. Temporary interruptions are possible due to technical maintenance, issues with external providers, or other circumstances beyond the Trader’s reasonable control. Nothing in these Terms & Conditions excludes or limits the statutory rights of consumers, or any liability of the Trader that cannot be excluded under the law.
14. Complaints and out-of-court dispute resolution
If a problem arises, the Customer may first contact Pandea Beauty using the details published on the site. Consumers may file complaints with the Bulgarian Commission for Consumer Protection (CPC) and use the applicable mechanisms for alternative out-of-court resolution of consumer disputes.
15. Applicable law and changes
Matters not settled in these Terms & Conditions are governed by the applicable law of the Republic of Bulgaria and applicable European Union law. Pandea Beauty Ltd may update these Terms & Conditions where the law, the site’s functionality, or the way services are provided changes. The current version is published on pandeabeauty.com together with its last-updated date. Changes do not affect rights under contracts already concluded, unless the law provides otherwise.
16. Standard withdrawal form
Use of this form is not mandatory — the Customer may also state their withdrawal in another unambiguous written statement. The return address and current contact details are stated in the “Contact” section of pandeabeauty.com and/or in the return instructions provided by Pandea Beauty.
